Item 1.04 Mine Safety – Reporting of Shutdowns and Patterns of Violations.

On May 23, 2023, the Company received a section 107(a) order issued by the Mine Safety and Health Administration (“MSHA”) under the Federal Mine Safety and Health Act of 1977 at its Stamper Underground Mine in Kansas City, Missouri. The order stated that maintenance personnel were working on a screen 12 feet off the ground without fall protection. Corrective action was taken, the order was terminated and no one was injured in the cited incident.
